IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. DISPUTE RESOLUTION

13.2 BINDING ARBITRATION

• Any dispute arising from these Terms or your use of the Services shall be resolved through binding individual arbitration

• The arbitration shall take place in Miami, Florida, or via telephone/video conference at your option
• The arbitrator's decision shall be final and binding
• You may pursue claims in small claims court if they qualify
• This arbitration agreement survives termination of these Terms
13.3 CLASS ACTION WAIVER
YOU AND ORVIA LABS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
• You may not participate in any class action lawsuit against us
• You may not bring claims on behalf of others
• You may not combine claims with other customers
• The arbitrator may not consolidate multiple persons' claims
13.4 Opt-Out Right
You have the right to opt out of the Arbitration and Class Action Waiver provisions by:

• Within 30 days of first accepting these Terms
• Including your name, address, and clear statement of opt-out intent
If you opt out, you and Orvia Labs agree to resolve disputes exclusively in the state or federal courts located in Miami-Dade County, Florida.

Your use of our Services is subject to our Privacy Policy, which is incorporated by reference into these Terms.
15. SUBSCRIPTION SERVICES
If you subscribe to any recurring delivery services:
• You authorize recurring charges at the interval you select
• You may cancel at any time by contacting customer support

• Refunds for subscriptions are subject to our 90-day money-back guarantee
16. TERMINATION
